At Hands Up Disability, we stand by the quality and compliance of our documentation. Our NDIS Certification Policies are meticulously designed to meet all relevant requirements of the NDIS Practice Standards.

We guarantee that should your NDIS auditor identify any non-conformance that is directly attributable to the content or structure of our provided documents, we will amend the documentation at no additional cost until the issue is resolved to the auditor’s satisfaction.

Conditions:

  • This guarantee is valid when the documentation has been implemented as provided, without material alterations to its core compliance components.
  • You must provide us with a copy of the relevant section of the audit report or finding for us to rectify.

Terms and Conditions of Use

1. Agreement By completing the purchase of this Documentation Kit (“the documents”), you (“the client”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

2. Intellectual Property Rights Hands Up Disability is the sole and exclusive owner of all intellectual property rights, including copyright, in the documents, which includes all policies, procedures, forms, and templates contained within the Documentation Kit.

3. Grant of Licence Upon receipt of full payment, Hands Up Disability grants the client a limited, non-exclusive, non-transferable licence to use, reproduce, and adapt the documents solely for the client’s internal business operations. This includes providing the documents to the NDIS Commission and Approved Quality Auditors as required for registration and audit purposes.

4. Licence Restrictions The client shall not, under any circumstances:

  • Sell, rent, sublicense, or otherwise commercially exploit the documents.
  • Reproduce, duplicate, or copy the documents for any purpose other than the permitted use outlined in Clause 3.
  • Distribute, share, or make the documents available to any third party, except as permitted in Clause 3.

5. Client’s Obligation to Tailor The client acknowledges their responsibility to tailor the provided document templates to meet the specific operational needs, context, and scale of their organisation.

6. Indemnity for Breach The client agrees to indemnify and hold harmless Hands Up Disability against any and all losses, damages, and costs (including legal fees on a full indemnity basis) incurred as a direct result of the client’s breach of the intellectual property and licence terms outlined in this agreement.

Scope of Responsibility and Limitation of Liability

1. Our Responsibility: Hands Up Disability warrants that the Documentation Kit is complete as described at the time of purchase. The document templates are designed to provide a framework that aligns with the requirements of the relevant NDIS Practice Standards.

2. Your Responsibility: The client acknowledges that the Documentation Kit provides templates that must be adapted, tailored, and implemented to suit the specific context of their organisation. The client is solely responsible for:

  • The proper implementation and integration of the policies and procedures into their operations.
  • Adequately training staff on all relevant policies and procedures.
  • Ensuring their daily practices align with their documented systems.

3. Limitation of Liability: To the maximum extent permitted by law (including the Australian Consumer Law), the total aggregate liability of Hands Up Disability to you for any loss or damage arising out of or in connection with the Documentation Kit is limited to the total amount paid by you for the documentation. Hands Up Disability is not liable for any indirect, special, or consequential loss. This clause does not exclude any rights or remedies you may have under the Australian Consumer Law that cannot be lawfully excluded.

Payment, Delivery, and Refund Policy

1. Payment and Delivery: Full payment is required via our accepted payment methods before the Documentation Kit is delivered electronically to your nominated email address.

2. Change of Mind: As our products are digital and delivered instantly, they cannot be returned. Therefore, please choose carefully, as we do not provide refunds if you simply change your mind, purchase the wrong product by mistake, or no longer require the product after delivery.

3. Consumer Guarantees: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. If the Documentation Kit experiences a major failure (for example, it is fundamentally not fit for its stated purpose of NDIS compliance and cannot be rectified by us within a reasonable time), you are entitled to a remedy. For a major failure, you have the right to choose a refund or a replacement.

4. Minor Issues: For any minor issues of non-conformance found within the documents, we will rectify them at no additional cost in line with our Guarantee of Support.
